Terms of Service
These terms govern your use of BrainBuddy — the web app at app.brainbuddy.morgansenechal.com, the BrainBuddy Gmail add-on, the BrainBuddy Chrome extension, and the BrainBuddy Android app (together, the "Service"). By creating an account or installing any of these clients, you agree to these terms.
1. What BrainBuddy does
BrainBuddy is an AI assistant that lets you save anything you read — articles, PDFs, screenshots, emails, your own notes — into a private, per-account knowledge graph, and ask questions across all of it. Your saved content is visible only to you.
2. Your account
- One person, one account. Don't share credentials.
- You're responsible for activity under your account, including content saved via any client (web, Gmail add-on, Chrome extension, Android).
- You must be at least 13 years old (16 in the EEA / UK).
3. Acceptable use
- Don't ingest content you don't have a right to store or process.
- Don't use BrainBuddy to build a derivative competing product (no scraping the UI into another search engine, no resale of generated answers as a service).
- Don't attempt to extract other users' data, bypass per-account isolation, or probe the system for vulnerabilities outside a responsible-disclosure context.
- Abuse — automated scraping, spam, attempts to bypass plan quotas, or attempts to circumvent the Gmail add-on's Limited Use scope — is grounds for termination without refund.
4. The Gmail add-on and your Google data
The BrainBuddy Gmail add-on accesses Google user data (the subject, sender, date, and body of the message you have open) only when you click "Save to BrainBuddy". How that data is handled — including the Google API Services User Data Policy and Limited Use requirements — is described in the Privacy Policy, which is part of these terms. You can revoke the add-on's access at any time from your Google account permissions page.
5. Plans, payments, refunds
BrainBuddy offers a Free plan and paid plans (Pro, etc.) with higher quotas. Paid subscriptions are billed monthly via Stripe. You can cancel at any time from Settings; service continues until the end of the paid period and then drops to Free automatically. No refunds for partial months. We may change prices for future billing periods with at least 30 days' notice via email.
6. Your content stays yours
You retain all rights to the content you save into BrainBuddy. You grant BrainBuddy a limited licence to store, process, index, and display that content back to you for the sole purpose of operating the Service. We do not use your content to train AI models. We do not sell it. We do not share it with other users.
7. Service availability and "as is"
BrainBuddy is provided on an "as is" and "as available" basis. We work hard to keep it running but make no warranty that the Service will be uninterrupted, error-free, or that AI-generated answers will be accurate. Don't rely on BrainBuddy answers for medical, legal, financial, or safety-critical decisions without independent verification.
8. Limitation of liability
To the maximum extent permitted by law, BrainBuddy's total liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid BrainBuddy in the 12 months preceding the claim, or (b) USD 50. BrainBuddy is not liable for indirect, incidental, or consequential damages, including lost data, lost profits, or loss of goodwill.
9. Termination
You can delete your account at any time from Settings → Danger zone; this permanently removes your saved content, chat history, and account record. We may suspend or terminate accounts that violate these terms or that we reasonably believe pose a security or legal risk to the Service or other users.
10. Changes to these terms
We may update these terms from time to time. Material changes will be announced via email and/or an in-app notice at least 14 days before they take effect. Continued use of the Service after that date means you accept the updated terms.
11. Governing law
These terms are governed by the laws of France. Any dispute that cannot be resolved informally will be brought before the competent courts of France, without prejudice to mandatory consumer-protection rights you may have under the laws of your country of residence.
